This is a master policy for all Trenton Hoyt LLC products and services.
1. Agreement
By using our websites or services, you agree to these terms, our Privacy Policy and our Fair Use Policy. If you use our services for an organization, you confirm you are authorized to accept these terms for it. A signed proposal or written agreement for specific work controls if it conflicts with these terms.
2. Products covered and order of precedence
These terms, our Privacy Policy and our Fair Use Policy are the master policies for every Trenton Hoyt LLC product and service, including Compass Campaign, Heron Dispatch, LawReach Connect and any product website we operate.
Some products have additional rules, listed in the product sections at the end of each policy. Those rules are part of these policies. Where a product rule speaks to a specific topic for that product, it applies to that product. Everything else is governed by the master policies. A signed written agreement for specific work controls over both.
3. Our services
We provide consulting, communications, website, outreach, digital and implementation services, along with client tools such as portals, invoicing and short links. The scope, schedule and price of paid work are set out in an accepted proposal or invoice.
4. Accounts
- You must be at least 16 years old to use our services, unless a product section below allows otherwise.
- Keep your sign-in details private and tell us promptly about any unauthorized use.
- Provide accurate information and keep it up to date.
- Privileged accounts may be required to use two-step sign-in.
- We may suspend access to protect the security of our services or other users.
5. Payments
- Invoices are due on receipt unless your agreement says otherwise.
- Payments are processed by third parties such as PayPal, under their own terms.
- Refunds are handled under your agreement or, where none applies, at our discretion and as required by law.
- We may pause work on accounts that are past due.
6. Your content
You keep ownership of the content you provide. You give us permission to use it as needed to perform the services. You confirm you have the rights to the content you provide, including names, images, logos and contact lists, and that any people you contact have given the required consent.
7. Our materials
Our websites, software, templates and branding belong to Trenton Hoyt LLC or its licensors. Final work products delivered to you are licensed or transferred as described in your agreement once paid in full.
8. Outreach and messaging compliance
When we send texts, calls or emails for you, you are responsible for having the consent the law requires, including under the Telephone Consumer Protection Act and CAN-SPAM Act, and for the accuracy of the content and contact lists you supply. Political communications must include any disclaimers required by law. Political text messages are sent through a third-party messaging vendor we contract with, as described in the Political text messaging section below.
9. Third-party services
Our services may connect to outside platforms such as payment processors, email providers and social networks. Their terms and privacy practices apply, and we are not responsible for their availability or actions.
10. Short links and QR codes
Short links forward visitors to other addresses. We may disable any link that is misleading, harmful or breaks our Fair Use Policy.
11. Preparation tools are not professional advice
Workspace tools for business formation, nonprofit and 501(c)(3) preparation, pay worksheets, check preparation, grants, certifications and similar tasks are self-help preparation aids. They are not legal, tax, accounting or financial advice, they do not file anything with a government agency, and they do not move money. Templates may not fit your situation or reflect the latest rules. Review all documents with a qualified professional and current official instructions before you rely on or file them. Using these tools does not create an attorney-client relationship with Trenton Hoyt LLC or with C.Y. Lee Legal Group, PLLC.
12. Workspace modules
We may turn workspace tools on or off for your organization based on your agreement, and some tools may be offered as paid add-ons. Tools marked as coming later or not yet available are not part of your service until we turn them on. You are responsible for the accuracy of what you enter and for reviewing any AI-assisted draft before you save, publish or send it.
13. Disclaimers
Except as stated in a written agreement, our websites and tools are provided "as is" and "as available." We do not guarantee specific results, such as election outcomes, fundraising totals, rankings or sales. Information on our websites is general and is not legal, tax or financial advice.
14. Limitation of liability
To the extent the law allows, Trenton Hoyt LLC is not liable for indirect, incidental, special or consequential damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid us for the service involved in the 12 months before the claim.
15. Indemnity
You agree to defend and hold us harmless from claims arising from your content, your contact lists, your misuse of the services or your violation of these terms or the law.
16. Ending service
You may stop using our services at any time, subject to any agreement you have with us. We may suspend or end access for violations of these terms. Amounts owed for work already performed remain due.
17. Governing law
These terms are governed by the laws of the State of Texas. Disputes will be handled in the state or federal courts located in Texas, unless your agreement says otherwise. We encourage you to contact us first so we can try to resolve any concern informally.
18. Changes
We may update these terms. The date at the top shows when they last changed. Continued use after a change means you accept the updated terms.
Compass Campaign terms
These rules apply to Compass Campaign in addition to the master policy above.
Who can use Compass Campaign
You must provide accurate account information, including your Texas voter ID or a statement that you are not registered to vote. Users under 18 may only use the service as volunteers with a participating campaign and with a parent or guardian's permission.
Campaign accounts and roles
Campaign admins control who joins their campaign and what role each member has, and are responsible for the conduct of the members they approve. We may suspend or remove any user or campaign that violates these terms.
Voter data restrictions
Voter data may only be used inside the Compass Campaign platform for your campaign's outreach. You may not sell, rent, publish, export for resale or share voter data outside the platform, or give access to your data or account to any other campaign, candidate, party or organization. Each campaign must obtain its own access. Texas law limits voter registration information to election, political and governmental purposes, and you are responsible for following those limits.
Data Ownership Agreement
- Shared records: voter records, organization records and organization contact people are owned by Trenton Hoyt LLC through the Compass Master file, including records a campaign uploads or improves, so there is one accurate record per person or organization.
- Campaign-owned data: each campaign owns its private notes, contact statuses, priorities, follow-up dates, outreach history, walk results and records marked campaign only. Other campaigns cannot see this data.
- License: while active, a campaign receives a limited, non-transferable license to use the shared records it can access, only inside the platform and only for its own outreach. Sharing voter data outside the platform ends the license immediately.
- When a campaign ends: it can request an export of its campaign-owned data, then it is archived. Shared records stay in Compass Campaign.
Data accuracy
Compass Campaign does not guarantee that it holds all data for your race, district or area. It is your campaign's responsibility to acquire, import and verify the data you rely on. Any data we provide is a convenience only, "as is" and "as available," with no warranty of accuracy, completeness, timeliness or fitness for a particular purpose.
No warranties and liability
Compass Campaign makes no promise about any outcome, including election results, contact rates or data coverage. To the fullest extent the law allows, Trenton Hoyt LLC accepts no liability arising from use of Compass Campaign, including lost votes, lost donations, election outcomes, compliance decisions, or actions based on data in the service. If this is found unenforceable, total liability is no more than the amount paid in the 12 months before the claim.
Payments are final
All Compass Campaign payments are final. No refunds, exchanges, credits or discounts are provided, including for downtime, errors, missing data or unmet expectations, except at Trenton Hoyt LLC's sole discretion.
Updates
Compass Campaign users will be asked to accept new versions of these terms before continuing to use the service.
Heron Dispatch terms
These rules apply to Heron Dispatch in addition to the master policy above.
The service
Heron Dispatch writes, designs, schedules and publishes social media posts based on your brand standards and website. Accounts are set up by Trenton Hoyt LLC in the customer Studio. Fees are set in your agreement.
Your posts and connected accounts
Only connect social accounts you are allowed to manage. You keep ownership of your logos, brand materials and website content and permit us to use them to create and publish your posts. You are responsible for posts published to your accounts, including any set to post automatically without approval.
Social networks
Posting depends on Meta and other networks. Their outages, rule changes or decisions to limit an account are outside our control.
Ending service
You may stop using Heron Dispatch at any time. After your account ends, you can ask us to delete your data.
Liability and disputes
Heron Dispatch is provided "as is." Total liability is limited to the fees you paid in the three months before the claim. Disputes are heard in Harris County, Texas.
Text messaging program terms
These rules apply to this platform in addition to the master policy above.
Program details
- Commercial text messages, such as marketing, promotions and service offers, are sent by Trenton Hoyt LLC or the client named in the message only to people who have agreed to receive them.
- Message frequency varies by program and is described when you sign up.
- Message and data rates may apply.
- Reply STOP to cancel at any time; you will receive one confirmation message. Reply HELP for help, or email connect@trentonhoyt.com.
- Carriers are not liable for delayed or undelivered messages.
- Consent to receive messages is never a condition of purchase.
- Messages are delivered through a third-party messaging vendor we contract with, which processes STOP and HELP replies as described above.
Political text messaging terms
These rules apply to this platform in addition to the master policy above.
Who sends the messages
Political text messages are sent through a third-party messaging vendor we contract with, not from our own systems. We rely on that provider to keep the sending platform compliant, including registering the program with wireless carriers (A2P 10DLC through The Campaign Registry), completing political verification such as Campaign Verify, processing STOP and HELP replies, and enforcing sending hours. Where the provider's platform rules are stricter than these terms, we follow the provider's rules.
That reliance covers the sending platform. It does not cover a campaign's message content, contact list, consents or government filings, which stay the campaign's responsibility as described below.
Rules that apply
Political and civic text messages, such as those from candidates, campaigns, parties, political committees and ballot measure groups, follow the specific rules that govern them, not the commercial texting rules above. Political texts are not commercial solicitations, but they are still regulated.
The vendor we contract with maintains the sending platform's compliance with the rules below and tells us what a program needs before it can send.
- Federal law: under the Telephone Consumer Protection Act (47 U.S.C. 227) and Federal Communications Commission rules, political texts sent with an autodialer or prerecorded content to a mobile phone require the recipient's prior express consent. There is no exemption for political speech.
- Person-to-person texting: messages that a real person reviews and sends individually, without an autodialer, may be sent to voters without prior consent where federal law allows. Opt-out requests are still honored.
- Carrier registration: political senders must register their texting program with the wireless carriers (A2P 10DLC through The Campaign Registry) and complete political verification, such as Campaign Verify, before sending.
- Identification and opt-out: every program identifies the sender, and recipients may reply STOP at any time. STOP requests are honored promptly and the number is not texted again by that program.
- Disclosures: political advertising includes the disclosure statement required by law, including Chapter 255 of the Texas Election Code and Federal Election Commission rules where they apply.
- Quiet hours and state rules: messages are sent only during the hours allowed by law, and any additional rules of the recipient's state are followed.
- Voter data: voter registration information is used only for election, political and governmental purposes, as Texas law requires.
Client responsibility
Campaigns and committees that use our texting services are responsible for the content of their messages, the lawful source of their contact lists, required consents, disclaimers and campaign finance reporting. Campaigns must also follow the messaging vendor's platform rules and supply whatever the vendor needs to register and verify a program. We may pause any program that we or the vendor believe does not meet these rules.
Google services and Google Ads terms
These rules apply to this platform in addition to the master policy above.
Advertising services
When we manage Google Ads or other paid advertising for you, ad spend is billed by the platform or passed through at cost as set in your agreement. Platforms decide whether ads are approved, and we do not guarantee placement, clicks, conversions or cost per result. You are responsible for the accuracy of offers and claims in your ads, and political advertisers must complete each platform's verification and disclosure requirements.
